I have just got back from 6 hours in the ER, plastered from toe to knee with a broken foot.

Friggin councils should maintain their footpaths a little better :dean:

8 day off work and as a contractor if I don't work I don't get paid. Then when I do go back I have to drag my sorry butt up 2 flights of stairs using crutches...yay.

Can you sue the ass of the council for not maintaining the path & loss of earnings????

sorry to here that
as i have broken my foot/ankle.
it will take a bit of time.and if you still get greaf from it have a MRI scan.
it will pick up any damage to the area

and if there pay for it and you need work on it to fix..
go the Institute of Sports Medicine ..
as they fix all the top sport guys..

Mrs HMS...take it easy, there is no doubt that councils and others have a responsibility but getting them to admit to fault or better still pay compensation is a long shot.

You have a better chance of winning Lotto than beating a local authority.

Anyway rest up and I trust you have a speedy recovery :wave-hi:

Sorry to hear of your caused misfortune by some one elses negligence you may find if u make a complaint re pathway that others allready may have done so allready.At best it could stop the same thing happening to someone else.

i know a person that fell of a ladder broke two wrists he wasnt insured he was of work three months
a friend went to see him in hospital
came out of the hospital and insured her husband
and to this day,i could be wrong, but he still is not insured and yes they are lawnies thats how i know about the story :i dunno:

i looked up klutz in the dictionary

i agree with admin hope everything goes well and your back on your feet soon in the mean time sit back and enjoy a few days rest you may as well enjoy it because there is nothing you can do about it

Here you go..took this today...the offender...

Spoke to the shop owner where I fell, he confirmed he has reported it to Council at least 6 times and has encouraged others who have fallen there to do the same.

For the litigators. Shore, get the hole fixed. Sue? sounds like a girls name. the hole didn't grab a leg, someone put a foot in it. maybe council can sue for inconvienience? once apon a time there were no footpaths. still aren't where I live. could have happened anywhere. doesn't make u a "Klutz" though Mrs HMS and i'm sorry you hurt yourself., Thats a fact.

I am a little concerned somebodys grandmother may step into the hole fall and pass away the elderly are very fragile and as Australians we should look after one and other . :frightene

That's exactly what I'll be saying when I send the picture to the Council. There is a large retirement village just around the corner from "the crater" and that footpath would be the direct route any of the elderly would take to walk to the supermarket and pharmacy.

If they still fail to fix it after my letter, I will take it to the local paper to embarrass them into action before someone really gets injured...more than a broken foot anyway. It doesn't take much for a senior cit to break a hip.

It's one of the wealthiest municipalities in Melbourne (Boorondara) yet has some of the most poorly maintained infrastructure I've ever seen.

I'm not litigious and do believe people should take responsibility for their own actions BUT the council certainly charges a pretty penny in rates, would be nice if they used some of it for maintenance, and I do believe they are responsible for ensuring a problem is fixed, especially when they are notified about it repeatedly.

Thats right Joe its about careing about the safety of one an other seriously joe shouldnt of happened its been reported no less than 6 times and each time somebody has had a problem the shop owner has had more stress to deal with besides running his business.
Shouldnt even be problem .
If we have a problem in DOVETON WE RING THE CITY OF CASEY AND ITS FIXED VERY VERY PROMPTLY ON 9 OUT OF TEN TIMES WE EVEN HAVE A HOTLINE FOR GRAFFITI ITS EXCELLENT. :laughing:

I agree with all that, especially looking after the aged and infirm. like I said get it fixed if you can, no excuse after being reported six times. My daughter hit a pothole in a car and had a collision as a consequense. broke her neck. She is ok though, has a titanium plate. and got some compensation through third party. My point is
Litigation has just about made it impossible for groups like the red cross ladies to hold a cake stand to raise funds for people who realy need help. havent seen one of those in ages. talk to rural fire service people about the trouble they have with insurance to hold a fund raising event. Neglegence need to be a bit more obvious for me, "sue the b###s" is just un Australian. I'm sure you agree...

I agree that 'sue the b******s' is a phrase used far too often these days in our 'no win - no fee, litigious society'... And I feel for the people whose insurance has increased due to this. That is because there are far too many people out there that are after a quick buck at others expense and that is definitely 'un-Australian' :mad:.

However, I feel that shouldn't mean that people who suffer due to negligence (such as an unsafe pavement, maintained by the council that accepts our rates but does nothing about it despite being called at least 6 times!!) should be penalized or stigmatized when they have a bona-fide reason to look for compensation due to loss of earnings. Interesting debate, what do others think?

You know they should be dealt with one way or another.
Maybe some one should fix it then send them the bill.
Maybe the council spent all the money on grog at the council meetings and cant afford it .
There is a town that couldnt block the main st On ANZAC DAY unless they paid the council 10,000 dollars to be able to divert the traffic while they do the march .
The council had no money so some good samaritan paid the 10,000 dollars .
What the hell is happening to this country :laughing:

MAYBE THEY DONT TRUST THE WEATHER MAN

Three or four days ago we had rain the grass was like hay now greening up nature is so cool

hi dean about council watering trees etc , i used to water the trees in your council area for a contractor , these waterings are a part of the contract
as you are aware lately, the rainfall has been below average & yes i have watered on day where is is expected rain
These days delivered low rainfall but with our waterings have given the trees a much needed boost & you will find the trees watered are usually (staked trees )
These trees are normally juvenile trees that have not been uplifted for pedestrian access etc !!
Rule of thumb with tree pruning is similar to grass cutting ! ie: no more than 30% removed @ any one time or you risk epicormic growth from shock as the tree tries to regain it's height & folage for it's health & wellbeing

I must say i found it very odd planting them only 3 months ago

When you know there isnt any water coming forth with from the heavens .

yes they are staked juvies they lost about half the first month then planted more

Keeps people employed thats the main thing all for it :)

yeah dean i agree about plantying trees in a drought but i guess we need them to help store water within & to decrease emissions from all the things we love to use like cars & elecricity etc , we all know at we do this & it's destroying our environment but then we plant trees & it uses our valuble water resourse !!!! what do we do ???? catch 22 eh !! lol :confused: oh well @ least council is trying to see that long term the trees will benefit our air quality etc even if they use our water resourses !! ;dealers; lol i guess we can live on recycled water eh !!! ;frosty; he he >>> oh well mt input done cheers :wave-hi:

Hi Mowjoman,

Thanks for thinking of me. I have healed nicely thanks, it was a little tricky getting up and down the stairs at work while on crutches (no elevator) but I got the hang of it and was also able to work remotely from home a far bit.

But guess what? The crater is still there. 3 weeks ago the council came out and fixed a smaller, shallower hole a couple of meters further along the footpath but completely ignored the huge hole that caused me to fall over. :dean:

I sent a letter to the council with a copy of the picture, described it's location etc and they did nothing. Think it's time to go to the local paper!

Hmmmm..... I don't want to sound all "Yeah that'd be right," but I must say I am not suprised that it hasn't been fixed. Like your idea admin, could even make sure the ol' trailer with your buisness name is positioned nicely in the background. Great advertising heehee :D The only way some people will do things sometimes is through embarrassment or one of the councilors wives or husbands breaking their foot :i dunno: . Anyway happy days and I hope they see the light Mrs HMS. :aus-flag:

OMG!!!!!!!!! They finally fixed the crater!!!! Perhaps my phone call telling them I was taking my story to the local paper did the trick (or would that be cynical of me :ebony: )
